PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Pre-Orders
DemonicArts only requires 50% of an order when purchasing any pre-order products! You are agreeing to pay mininum of 50% of your order value, including shipping fees until the order is ready for shipping. When the order is complete you will be notiefied by email and 30 days will be given to pay the remaining amount owed plus 5%! Failure to do so will add a 15% charge of the full amount of the order.

Payments
Payments must be made within 14 days of ordering in full (except pre-orders), payable to DemonicArts. DemonicArts has the right to charge 10% on late payments and claim compensation for debt-recovery costs!
In an attempt to stop fraudelent ordering, DemonicArts has teamed up with a anti-fraud company, which displays your I.P address and any records which may be held against you! DemonicArts can refuse to sell to any black listed IP address.

Charges and Fees

Pre-Orders

Returns

Stocking Fees

A 15% stocking fee is applied for returned merchantdise or if your order has been ordered by ourselves and you would like to cancel.

A 50% stocking fee is applied for returned footwear in: all colours that are not Black.

An additional 15% stocking fee is charged for using a paypal dispute against us. |

Some brands/products are sometimes subject to delays, in these cases you will be informed. Delays could be due to a shipment halted in customs, a manufacturer requiring a certain material.
Paypal disputes actually hold up other customers orders, please try and resolve with us first. Any customers opening a paypal dispute will not be able to return items for store credit.
If your order was placed without a recorded method of shipping, this will be billed for as disputes require this as proof of shipping.
We do our best to resolve all disputes ASAP.

Typographical Errors
In the event that a DemonicArts product is mistakenly listed at an incorrect price, DemonicArts reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. DemonicArts reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, DemonicArts shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by DemonicArts without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

DemonicArts may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to DemonicArts.
Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of DemonicArts products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of DemonicArts products) must be commenced within one (1) year after the claim or cause of action arises. DemonicArts's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. DemonicArts may assign its rights and duties under this Agreement to any party at any time without notice to you.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a DemonicArts or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
Participation Disclaimer
DemonicArts does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, DemonicArts is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. In an attempt to provide increased value to our visitors, DemonicArts may link to sites operated by third parties. However, even if the third party is affiliated with DemonicArts, DemonicArts has no control over these linked sites, all of which have separate privacy and data collection practices, independent of DemonicArts. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, DemonicArts seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
RETURNING CUSOMTER ITEMS

Merchandise Return Policy
To be eligible for credit, all returns must meet the following conditions:
1. Merchandise was ordered directly from DemonicArts and supported by a DemonicArts invoice.
2. Merchandise must be returned within fourteen (14) days of the invoice date. Returns after fourteen (14) days of the invoice date will receive a maximum of 50% of the invoice value. No returned merchandise will be accepted after thrity (30) days from the invoice date.
3. Merchandise is in the original packaging. Returns will NOT be accepted if the returned merchandise is not in its original packaging, or if the packaging bears any hand written marks such as style and/or sizing. All stickers or labeling applied to the packaging or the merchandise itself must be removed prior to returning; otherwise a 10% service charge will be assessed.
4. Merchandise must be clean, unused, and in saleable condition.
5. Merchandise is not from any of the DemonicArts “Sales” offers.
6. DemonicArts reserves the right to refuse returns due to claims relative to merchandise’s sizing, fitting, colour, or dimensions, and has the final say in this regard.
Merchandise Return Procedure
1. Please contact us so we can give you return authorization number. We will post you a return label only when the return is either due to DemonicArts shipping error or a manufacturing defect. 2. Completely fill out the Merchandise Return Form (HERE) and attach it with the returned merchandise. Merchandise returned without the completely filled out Merchandise Return Form is subject to a 10% service charge. This includes without a Return Authorization number (RA#). 3. Affix the Return Label to the package to be returned. Merchandise received without a Return Label from DemonicArts will be refused and returned unopened to the sender. DemonicArts is not responsible for the shipping charge incurred from returns without a return label. 4. Please note that we do not issue call tags. All returns must be prepaid. Collect returns, authorized or not, will be refused. 5. All returns due to DemonicArts shipping error or a manufacturing defect must be shipped via a sign for Postal Service. If returns are shipped via any other methods, this may delay the credit. CREDIT ISSUANCE POLICY
1. Full credit will be given on goods returned due to manufacturing defect or shipping error. In either case, DemonicArts will also reimburse the applicable shipping charge to the customer. In No event shall our liability extend beyond the full credit and the shipping charge. Shipment of replacement merchandise is limited to Standard Parcels only and cross shipping will be charged before DemonicArts receives the return merchandise.
2. Returns for reasons other than the above are subject to a 15% handling and restocking fee. In addition, the customer is responsible for the shipping charge.
3. No credit will be given on goods that have been altered in any way, or show signs of intentional tampering or excessive wear. DemonicArts reserves the right for the final judgment in this regard.
4. No credit will be given until the returned merchandise has been inspected and evaluated by DemonicArts upon approval.
5. A cash refund can only be refunded if DemonicArts has sent the incorrect item, or the item is damaged.
6. Cash will be sent by cheque & credits can be applied to open invoices and future orders only.
